2. PURPOSES OF AND LEGAL BASIS FOR THE DATA PROCESSING

2.1 Log data

When you visit our Website, we receive log data sent by your browser (e.g. IP address, previous website visited, time and date, displayed contents, information regarding the browser and operating system).

Collecting log data is technically required to enable you to use our Website and therefore necessary for the performance of a contract (Art. 6 para. 1 lit. b GDPR). Without the provision of this data, using our Website is not possible. The log files will be stored for as long as necessary for the respective purpose, in principle no longer than fourteen (14) days.

2.2 Contact form and other requests

When sending us inquiries using our contact form or via our email address, we process the data provided by you (in particular, your email address and your text input) in order to process and respond to your inquiry. When using our contact form, you can optionally provide your name, country and occupation as well. The provision of your occupation and country help us to understand the background of your inquiry and to set you up with persons that have the right language skills to answer you inquiry.

The processing of this data is necessary for the performance of a contract, i.e. responding to your inquiry (Art. 6 para. 1 lit. b GDPR). Without the provision of this data, responding to your request is not possible.

2.3 Newsletter and promotional messages

Based on your consent, we collect your name, email address and language settings, when you register for our newsletter and promotional messages. We process such personal data to send you information about our and/or Boehringer Ingelheim group companies’ products and services (also including satisfaction inquiries, updates, features and success stories) and/or other animal healthcare related topics by email.

You may withdraw your consent from receiving such promotional communications at any time with future effect. You can do so by following the instructions included in such promotional communications or contacting our customer service [e.g. by sending us an email to our contact details set out under Sections 1 and 5.2(a)].

The basis for such data processing is your consent (Art. 6 para. 1 lit. a GDPR). The withdrawal of your consent will not affect the lawfulness of processing based on your consent before its withdrawal. Your consent is not required for the use of our Website.

2.4 Value Calculator

Using our Value Calculator, you can estimate the potential benefits of using our product SoundTalks. In order for the Value Calculator to be able to calculate your potential savings, you need to enter certain data about your pig population (in particular, the number of heads per batch, average weight per pig, average days-on-feed, feed cost and market price). Because it cannot be completely ruled out that you could be identifiable via your IP address, the data you provide about your livestock could possibly be considered personal factual data.

To the extent that this is the case, the processing of this data is necessary for the performance of a contract, i.e. calculation of your potential savings (Art. 6 para. 1 lit. b GDPR). Without the provision of this data, the use of our Value Calculator is not possible.

2.5 Use of Cookies and related data processing

We use cookies (small files placed on your browser) and similar technologies such as pixel tags (hereinafter collectively “Cookies”). Cookies can be divided into essential and non-essential Cookies:

2.5.1 Essential Cookies

Essential Cookies are necessary for our Website to function properly by providing basic features such as page navigation, access to secure areas of our Website or language settings.

Essential Cookies and the related data processing are required to enable you to use our Website and its basic features and are therefore necessary for the performance of a contract (Art. 6 para. 1 lit. b GDPR and Section 25 of the German Telecommunications Telemedia Data Protection Act). Essential Cookies are stored for up to one (1) year.

Based on your consent, we set Cookies and analyze how you are using our Website. This way, we collect information about how well certain services are received and we can adjust and improve them as well as our Website.

The related data processing is based on your consent (Art. 6 para. 1 lit. a GDPR and Section 25 of the German Telecommunications Telemedia Data Protection Act), which you may withdraw at any time here. The withdrawal of your consent will not affect the lawfulness of processing based on your consent before its withdrawal.

In addition to the information provided in our Cookie management tool, we would like to provide you with the following information about some of the third-party tools we use:

a) Adobe Analytics

Based on your consent, we are using Adobe Analytics, a web analytics service by Adobe Systems Software Ireland Ltd., 4-6 Riverwalk, Citywest Business Campus, Dublin 24, Republic of Ireland (hereinafter “Adobe”), which acts as our data processor for the purposes of the related data processing.

Adobe Analytics allows us to analyze all traffic and usage patterns of individual users (without further identification) or groups (e.g. which services are used how often, how frequently do users return, how long do they stay, which websites and which region are users coming from). The Cookies set by Adobe Analytics are stored for up to three (3) years.

The data processing by Adobe Analytics may include the following information:

  • Where you go and what you do on our Website;
  • your web browsing activity;
  • the URL of the page that brought you to our Website;
  • the web search you performed that led you to our Website;
  • information about your web browser and device (such as device type, browser type, advertising identifier, operating system, connection speed and display settings);
  • your IP address, which may be used to approximate your general location (in order to protect your personal data as much as possible, your IP address is shortened and replaced with a generic IP address);
  • location information from your mobile device or web browser;
  • social media profile information;
  • information you may provide on our Website or when interacting with our social media pages; and
  • ad campaign success rates, such as whether you clicked on an ad and whether viewing or clicking on the ad led to your purchase of that product.

Please note that Adobe may also process the data collected from you for its own purposes. Since we have no influence on such processing by Adobe, Adobe is solely responsible for such processing for its own purposes.

Please also note that Adobe is likely processing your personal data in countries outside the European Union (EU) / the European Economic Area (EEA), in particular the U.S. The U.S. is a so-called “third country” for which there is no adequacy decision of the European Commission pursuant to Art. 45 GDPR and it cannot be guaranteed that Adobe can ensure an adequate level of data protection in accordance with the requirements of the GDPR. In particular, it cannot be ruled out that U.S. authorities may be able to access your personal data and that no effective legal remedies are guaranteed for EU citizens.

We use Adobe Analytics exclusively on the basis of your explicit consent (Art. 6 para. 1 lit. a GDPR), which you may withdraw at any time here. The withdrawal of your consent will not affect the lawfulness of processing based on your consent before its withdrawal. Your consent to the use of Adobe Analytics is not required for the use of our Website.

b) YouTube

Based on your consent, we are using the so-called “YouTube Player” by YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, U.S. (hereinafter “YouTube“) on our Website to embed on our Website videos stored on the YouTube platform. YouTube is a company affiliated with Google LCC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, U.S. (hereinafter “Google“).

In order to protect your personal data as much as possible, we integrate the YouTube Player using a so-called “2-click solution”. This means that instead of the YouTube Player, only a placeholder is initially displayed. Only when you have given your consent by confirming a corresponding button within the placeholder, the actual YouTube Player is loaded and a connection to the YouTube servers is established. Furthermore, we use the YouTube Player in the so-called “Privacy-Enhanced Mode”. According to YouTube, in this setting no cookies are exchanged before a video is played. Please note, however, that we have no influence on the data processing by YouTube. It can therefore not be ruled out that – even in the so-called “Privacy-Enhanced Mode” – cookies are exchanged or personal data is processed by YouTube (or partner companies of YouTube) before a video is played.

After you have started the playback of a video embedded on our Website, a connection to YouTube’s servers is established and Cookies are exchanged. Please note that we have no influence on the data processing that takes place in this context and on which personal data is transferred to YouTube. However, it can be assumed that YouTube can in particular track that you have visited our Website. We also have no influence on whether YouTube uses the personal data collected from you for purposes other than providing the YouTube Player and playing the respective video. According to YouTube, your information will not be used to personalize advertising.

Please also note that YouTube is likely processing your personal data in countries outside the European Union (EU) / the European Economic Area (EEA), in particular the U.S. Furthermore, the data stored by YouTube can possibly also be accessed and processed by other Alphabet companies, such as Google. The U.S. is a so-called third country for which there is no adequacy decision of the European Commission pursuant to Art. 45 GDPR and it cannot be guaranteed that YouTube can ensure an adequate level of data protection in accordance with the requirements of the GDPR. In particular, it cannot be ruled out that U.S. authorities may be able to access your personal data and that no effective legal remedies are guaranteed for EU citizens.

We use the YouTube Player exclusively on the basis of your explicit consent (Art. 6 para. 1 lit. a GDPR), which you may withdraw at any time here. The withdrawal of your consent will not affect the lawfulness of processing based on your consent before its withdrawal. Without your consent, you cannot use the YouTube player and play the embedded videos. However, your consent to the use of the YouTube player is not required for the use of our Website in general.

2.6 Pharmacovigilance

If you report adverse events, information about side effects or other medical aspects (hereinafter “Pharmacovigilance”) concerning a Boehringer Ingelheim product, we will review and analyze this data.

All reports will be shared with Boehringer Ingelheim International GmbH who is operating the global Pharmacovigilance database.

Boehringer Ingelheim is obliged to report Pharmacovigilance relevant information to health authorities worldwide (including to countries that may have a lower level of data protection compared to the EU/EEA). The legal basis is Art. 6 para. 1 lit. c GDPR and for transfers outside the EU/EEA Art. 6 para. 1 lit. f and Art. 49 para. 1 lit. e GDPR. The reports will contain details about the incident but only limited personal data:

  • For patients, the report will only contain, age, gender and initials (as provided), but never the patient’s name.
  • For the reporting individuals, the report will include the name, profession (e.g. physician, pharmacist), initials or address, email and phone number (as provided). The contact information is required to be able to follow-up with the reporter to gain high quality and complete information on adverse events. The reporter can select that his or her contact details are not provided to Boehringer Ingelheim or authorities.

As reports about adverse events are important for public health reasons, they are kept for a minimum of ten (10) years after withdrawal of the product in the last country where the product was distributed.

2.7 Further purposes which we process your personal data for

If necessary, we process your personal data for additional purposes:

  • Satisfying our legitimate interests (Art. 6 para. 1 lit. f GDPR), including the following:
    • (i) To complete a corporate transaction (e.g. corporate restructuring, sale or assignment of assets, merger);
    • (ii) to protect, enforce and defend our rights, property and interests;
  • ensuring compliance with legal obligations, court orders or other binding decisions of public authorities (Art. 6 para. 1 lit. c GDPR).

3. DATA TRANSFER

We do not share personal data with any third party, unless this (a) is necessary to provide our Website or our services, (b) is permitted by applicable law or (c) has been agreed by you. We may share personal data with the following third parties:

3.1 Reporting obligations to regulatory authorities and enforcement of rights

In order to protect our rights or the rights of third parties, we may disclose data to rights holders, consultants, courts and authorities in accordance with legal provisions.

3.2 Service providers (processors)

We engage service providers to process your personal data for the purposes described in this Privacy Policy. These service providers (including Boehringer Ingelheim group companies and third parties) support us, for example, in the technical operation, provision, hosting, maintenance and support of our Website, data management, the provision of services, marketing measures and the analysis of our Website. In this capacity, these service providers act as data processors within the meaning of Art. 4 no. 8 GDPR and process the data only on our behalf, according to our instructions, under our control and in accordance with this Privacy Policy. To this end, we have concluded data processing agreements (Art. 28 GDPR) with such service providers.

If it is not possible to adequately protect your data, we will inform you at the relevant point about the respective details of the transfer and the associated data protection risk and ask for your consent to the data transfer in advance.

4. RETENTION PERIODS

We will only store your personal data as long as necessary to fulfil the purposes for which they were collected or – where the law provides for longer retention periods – for the duration of the retention period required by applicable law. After that your personal data will be deleted.

We have specified retention periods for certain processing purposes above.

5.1 Your Rights

You have the following rights in accordance with applicable data protection law. For this purpose, please contact us under the contact details specified in Sections 1 or 5.2(a).

a) Right of access, rectification, erasure and restriction of processing: You have the right to obtain at any time access to your personal data stored by us. If we process or use your personal data, we shall endeavor to ensure by implementing suitable measures that your personal data is accurate and up-to-date for the purposes for which they were collected. If your personal data is inaccurate or incomplete, you have the right to obtain the rectification of such personal data. Furthermore, you may have the right to obtain the erasure or restriction of processing of your personal data, for example if no legitimate business purpose exists anymore for the data processing under this Privacy Policy or applicable law and the further storage is not necessary under statutory storage obligations.

b) Right to data portability: You may have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format or to transmit this data to another controller.

c) Right to withdraw your consent: If you have given your consent to the collection or processing of your personal data, you have the right to withdraw your consent at any time without affecting the lawfulness of processing based on the consent before its withdrawal. You may also object to use of your personal data for purposes of market research and public opinion polling as well as advertising and unsubscribe from our newsletter and other promotional messages.

Right to object:

If the processing of your personal data is based on legitimate interests (Art. 6 para. 1 lit. f GDPR), you have the right to object to this processing. Unless there are compelling legitimate grounds for processing on our side, the processing of your personal data under legitimate interests will cease on such legal basis.

In addition, you have the right to object to the processing of your personal data for direct marketing (e.g. in the case of electronic advertising). In the event of an objection, your personal data will no longer be processed for direct marketing.

If your personal data is transferred to a country outside the EU that does not provide an adequate level of data protection, you can request a copy of the contract that ensures the adequate level of protection.
